In short: we only collect what you send us (for example through the contact form), we use it to answer you and help you buy or sell property, we never sell it, and you can ask us to see, correct or delete it at any time by emailing contact@toplistingsrivieramaya.com.

1. Who is responsible for your data

Robin Dizer, doing business as Top Listings Riviera Maya ("we", "us"), with address at La Roca, Blvd. Cumbres, m 310, Mz 109, Cancún, Quintana Roo, Mexico, is responsible for the processing of your personal data. Contact: contact@toplistingsrivieramaya.com, +52 998 242 8475.

2. Personal data we collect

Data you give us: name, email address, phone / WhatsApp number, your reason for contacting us, budget range and timing (optional), the property you are interested in, your message, and your preferred way of being contacted.
Data from your visit: the pages viewed, the website that referred you, an approximate country (from your internet connection) and device type. This is counted with an anonymous code that changes every day; we do not use cookies for it and cannot identify you from it.

We do not ask for sensitive personal data. Please do not send passport, banking or other financial details through the website form.

3. Why we use your data

Primary purposes (necessary for our relationship with you)

To answer your enquiry and keep in contact about it.
To send you properties that match what you are looking for, and arrange viewings or video calls.
To assist you through a purchase, sale or rental, including coordinating with notaries, lawyers, banks, developers or sellers when you ask us to.

Secondary purposes (optional)

To send you occasional news about new listings or market updates — only if you ask for them. You can unsubscribe at any time with the link in each email or by writing to us.
To understand, in aggregate, how the website is used so we can improve it.

If you do not want your data used for the secondary purposes, email us at any time; this will not affect our service to you.

4. Who we share it with

We do not sell or rent your personal data. We share it only:

With service providers that store or process data on our behalf, under contract and only for these purposes: website hosting and security (Cloudflare, Inc.), database hosting (Supabase, Inc., servers in the United States) and email (Google Workspace).
With notaries, lawyers, banks (for the fideicomiso), developers or sellers involved in a transaction — only when you ask us to proceed with that transaction.
When required by Mexican law or by a competent authority.

Some of these providers are located outside Mexico (mainly the United States); they act on our instructions and protect your data with security measures.

5. Your rights (ARCO)

You may Access your personal data, Rectify it if it is wrong, Cancel (delete) it, or Oppose its use for specific purposes, and you may revoke your consent or limit how we use your data. To do so, email contact@toplistingsrivieramaya.com with:

your name and an email or address where we can reply;
a copy of an identification document (or your representative's authorisation);
a clear description of the data and the right you want to exercise.

We will reply within the time limits set by Mexican law (generally 20 business days) and apply any accepted request within the following 15 business days. If you believe your rights have not been respected, you may contact the competent Mexican data-protection authority.

Visitors from Canada and the United States: you can make the same requests to us at any time. We do not sell or "share" personal information for advertising.

6. How long we keep it

We keep enquiry details while we are in contact with you and for a reasonable period afterwards to follow up, or longer where the law requires records of a transaction. Anonymous visit statistics are deleted after 13 months.

Datos que recabamos: nombre, correo electrónico, teléfono / WhatsApp, motivo de contacto, presupuesto y plazo (opcionales), la propiedad de su interés, su mensaje y medio de contacto preferido. También estadísticas anónimas de visita (páginas vistas, sitio de procedencia, país aproximado y tipo de dispositivo), sin cookies. No solicitamos datos personales sensibles.

Finalidades primarias: atender su solicitud; enviarle propiedades acordes a lo que busca y coordinar visitas o videollamadas; asistirle en la compra, venta o renta de inmuebles, incluyendo la coordinación con notarios, abogados, bancos, desarrolladores o vendedores cuando usted lo solicite.

Finalidades secundarias: enviarle novedades de propiedades o del mercado, solo si usted lo solicita; y conocer de forma agregada el uso del sitio para mejorarlo. Puede negarse a estas finalidades en cualquier momento escribiendo al correo indicado, sin que ello afecte el servicio.

Transferencias: no vendemos ni rentamos sus datos. Solo los compartimos con proveedores que los tratan por nuestra cuenta (Cloudflare, Inc.; Supabase, Inc., con servidores en Estados Unidos; Google Workspace), con notarios, abogados, bancos, desarrolladores o vendedores cuando usted nos pida avanzar con una operación, y cuando lo exija la ley o una autoridad competente.

Derechos ARCO y revocación del consentimiento: usted puede acceder, rectificar, cancelar u oponerse al tratamiento de sus datos, así como revocar su consentimiento o limitar su uso, enviando un correo a contact@toplistingsrivieramaya.com con su nombre, medio para responderle, copia de identificación (o documento que acredite la representación) y la descripción clara de los datos y del derecho que desea ejercer. Responderemos en los plazos que establece la ley (en general, 20 días hábiles) y haremos efectiva la solicitud procedente dentro de los 15 días hábiles siguientes.
